THE ICEBREAKER

All licenses are for use of the UNMODIFIED IMAGE. Each license covers one of the following use categories:

Presentation

Purpose: Indefinite use of the unmodified image where the cartoon will be used internally either within a presentation. Includes electronic rights for uploading/archiving the document containing the cartoon on the internet.

Description: Presentations: Uses where the cartoon will be used in a internal context and will not be used in an outward facing promotional context. This business presentations to the purchasing organization's own staff, clients/customers, suppliers or other stakeholders, where the cartoon is not made available outside the presentation. This license allows an unlimited number of uses of the document containing the cartoon by the licensing individual, as well as the production of up to 1,000 presentation handouts per year for an indefinite period.

This license also covers use for training and educational use by commercial (for profit) training companies/organizations. This license excludes use in company reports or newsletters with a print run of over 1,000 in any calendar year and all business brochures.

This license additionally includes electronic rights for uploading/archiving the cartoon within a document to one fixed URL on the internet.

Website/Blog/Electronic Publication

Purpose: Indefinite use of the unmodified image at one URL or in one electronic publication.

Description: Website/Blog/Electronic Publication: Use at one URL for an indefinite period. A blog is defined as a regularly updated weblog presented in a "diary" format sorted by date. It may be hosted on the user's own web server, or through a third party blogging service such as Wordpress.com.

Country of Publication / Use: Worldwide.

OR

Forum/Social Media

Purpose: Indefinite use of the unmodified image at one URL, where that URL is a page on a social networking website or a posting on a web forum.

Description: Forum/Social Media - Use at one URL for one month, where that URL is a page on a social networking website or forum.

A social networking website is defined as a template-driven personal web page hosted within a larger webspace with a view to social networking, examples of such sites are Facebook.com or Twitter.com. A web forum is defined as an internet based discussion group either accessible to the general public or limited to a specific group of users.

Your forum or social networking page may take advertising managed by the hosting website as a whole, but if advertising on it is managed by yourself and the resulting revenue earned directly by yourself, or the page is intended for commercial gain by promoting the writer's business or selling products or services, then this would constitute a commercial forum or social networking page and is not covered by this license.

Newsletter

Purpose: Indefinite use of the unmodified image where the cartoon will be used internally either within a print or digital newsletter. Includes electronic rights for uploading/archiving the document containing the cartoon to one fixed URL on the internet.

Description: Newsletters: This license covers an unlimited number of uses by the licensing individual and the production of a total of up to 1,000 presentation handouts per year for an indefinite period.

This license also covers use for training and educational use by commercial (for profit) training companies/organizations. This license excludes use in company reports or newsletters with a print run of over 1,000 in any calendar year and all business brochures.

Country of Publication / Use: Worldwide.

Commercial Publication - Single country

Purpose: Uses where the unmodified image will be part of a publication (not the cover) made available to people outside the purchasing organization. This includes all print publishing uses where the image is part of the editorial content of the publication and will be used at half page size or smaller. Also covers use in magazines, catalogues or brochures sold, taking paying advertising, or used in the promotion of a commercial entity. All Commercial Publication licenses include electronic rights.

Description: Public Printed Use, Commercial: Use where the cartoon will be part of a publication (not the cover and printed at less than half page size) made available to people outside the purchasing organization. This includes print publishing use where the image is part of the editorial content of the publication. You are permitted to reproduce the image in any electronic format as part of the same content and in the same context as it is used in the print publication.

Publication only permitted in newspapers, magazines, books, catalogues and brochures sold, taking paying advertising, or used in the promotion of a commercial entity.

Use: Single country

OR

Commercial Publication - Worldwide

Purpose: Uses where the unmodified image will be part of a publication (not the cover) made available to people outside the purchasing organization. This includes all print publishing uses where the image is part of the editorial content of the publication and will be used at half page size or smaller. Also covers use in magazines, catalogues or brochures sold, taking paying advertising, or used in the promotion of a commercial entity. All Commercial Publication licenses include electronic rights.

Description: Public Printed Editorial Use, Commercial Small Circulation: Use where the cartoon will be part of a publication (not the cover and printed at less than half page size) made available to people outside the purchasing organization. This includes print publishing use where the image is part of the editorial content of the publication. You are permitted to reproduce the image in any electronic format as part of the same content and in the same context as it is used in the print publication

Publication only permitted in newspapers, magazines, books, catalogues and brochures sold, taking paying advertising, or used in the promotion of a commercial entity.

Use: Worldwide.

OR

Newspaper Publication – Local/Regional/National/International

Purpose: Single use of the unmodified image in a daily or weekly newspaper, no more than ¼ page size. Includes indefinite electronic rights.

Description: Single use in a daily or weekly newspaper. This license covers an unlimited print run and the rights to include the image in any electronic formats for an unlimited timescale so long as the image is used in the same context as in the print publication. The image must not be displayed at more than quarter page size.

License

JackZiegler.com grants the image user a non-transferable, non-exclusive right to copy the JackZiegler.com image(s) stated above onto their computer and to use the JackZiegler.com image(s) and any derivatives or copies (collectively, the "image(s)") on their personal or company computer(s). This license is valid only with respect to the image(s), provided the applicable license fee stated above is paid within the time period set out above.

This license grants the image user only use of the image(s) for the purpose stated above. The image user may not use the image for any other purpose without prior written agreement from JackZiegler.com.

The image user may not publish a modified version of the image(s) or any part of the image(s) without prior written agreement from JackZiegler.com. He/she may however modify the image(s) caption font to his/her satisfaction without prior agreement from JackZiegler.com.

The specified image(s) may not be sold or sublicensed alone or as part of any product other than the product/publication to which this license refers. Use of the image(s) on or in a product does not grant or purport to grant the right to duplicate or distribute the image(s) to any third party or end user.

General

Pornographic, defamatory, libelous or otherwise unlawful use of the image(s) is prohibited.

Where a credit is required, the following wording will be displayed in the immediate vicinity of the image(s): "www.JackZiegler.com".

All rights to the image(s) are owned by JackZiegler.com and Ziegler Toons, LLC and are protected by United States copyright laws, international treaty provisions and other applicable laws. The license will terminate automatically without notice from JackZiegler.com should the image user fail to comply with any provision of this agreement.

For reasons of satirical comment or parody, artists may occasionally include in a cartoon ("the work"), a trademark, trading name, individual's name, otherwise copyrighted term or a feature of the rights of publicity of an individual (collectively "third party intellectual property"). While JackZiegler.com has permission to license the original work, the permissibility of mentioning trademarks and other forms of third party intellectual property within the work depends on the specific use of the cartoon and the country/jurisdiction in which it is being used. JackZiegler.com can never be aware of all case law and statute in all countries, therefore ensuring that use of a cartoon incorporating such third party intellectual property is acceptable in any specific context is the responsibility of the licensee and JackZiegler.com does not give any warranty in this respect.

The image user shall, upon request provide a copy to JackZiegler.com of any publication containing image(s) licensed from JackZiegler.com.

NOTE: Any image licensed under a custom license agreement not listed above will be licensed under the pre-agreed terms.
